Dishonored Check

A person who passes a bad check on insufficient funds shall be liable to the payee for treble the amount of the check up to $1,500.00 in damages.


A payee of a check may collect up to an additional $1,500.00 in treble damages on a bad check issued by the maker to the payee.

To be able to collect this amount the payee must mail a certified letter of demand to the person who passed the check and the letter must inform 1) of the provisions of the section under which demand is made and 2) the amount of the check.

The debtor has 30 days thereafter to make restitution of the original check and failure to do so will result in liability for treble damages.
